Step-by-step procedure
Section actions
- 1Check that the mobility lease is right for you: it always covers a furnished accommodation, for 1 to 10 months. For a long term rental, opt for a classic furnished lease.
- 2Make sure the accommodation is actually furnished according to the law: bed, cooking, refrigerator, dishes, table, chairs, storage, lighting. If items are missing, the lessor must provide them.
- 3Confirm the reason for the contract: attach to the lease a proof of your temporary situation (contract, certificate). Without this, the lease is not valid as a mobility lease.
- 4Check the security deposit: for the mobility lease, it is capped at one month of non-charge rent. Demanding more is illegal.
- 5Read the contract carefully before signing: duration in months, amount of rent and expenses, condition of the accommodation (state of the property). You have at least 24 hours to review the status of the entry points.
- 6Anticipate your departure. The lease ends on the scheduled date, without renewal. To stay longer, you have to sign a new contract (classic lease) — extending a mobility lease over the same period is prohibited.
Common mistakes
Section actions
- Believe that the mobility lease is renewable. The ELAN law makes it non-renewable: 10 maximum months, then a new contract is required.
- Accept a deposit greater than one month. It's illegal for this kind of lease.
- Do not attach the proof (stage, studies, etc.): without it, the lease loses its mobility lease status.
- Sign the status of the site without checking it. Any defects not noted at entry will be deducted from the deposit.
