New lease models come into effect from October 1, 2026

As of October 1, 2026, standard lease contracts have evolved for empty, furnished rented housing and single lease co-locations. The new models incorporate the resolution clause in the event of unpaid payments, a statement on the principal residence requirement and optional telephone contact information. These changes relate to leases entered into or renewed from that date.

Who is concerned

Tenants and lessors of rented housing empty, furnished and single-lease co-locations, for leases concluded or renewed from October 1, 2026. The model applicable to furnished rentals does not apply to mobility leases or furnished holiday rentals or guest rooms.

Background

Decree No. 2026-596 of 6 July 2026, published in the Official Gazette on 7 July, amends the standard lease agreements. The resolution clause is not a novelty: it is the result of Act No. 2023-668 of 27 July 2023 to protect housing from unlawful occupation and already applies to leases concluded or renewed since 29 July 2023. The decree simply adapts regulatory models to this development.

What Changes
